Horizon Mechanical Solutions – Terms and Conditions

1. General

1.1. These Terms and Conditions ("Terms") apply to all services provided by Horizon Mechanical Solutions ("HMS", "we", "our", or "us")

to the customer ("you" or "the customer").

1.2. By engaging our services, you agree to be bound by these Terms in full, whether the engagement is verbal, written, or implied.

2. Quotes and Estimates

2.1. All quotes provided by HMS are estimates only and are subject to change upon inspection and during the course of work.

2.2. If further faults or issues are discovered, you will be notified, and additional charges may apply.

2.3. A 50% deposit is required on all quotes over $1,000 (AUD) before work begins. No work will commence until the deposit is received.

3. Payment Terms

3.1. All invoices are strictly payable within 14 days from the date of issue.

3.2. Failure to pay on time may result in service delays and/or additional charges.

3.3. All debt collection costs (including agency fees, legal expenses, and administration fees) incurred in

recovering overdue payments will be added to the total

outstanding amount and are payable by the customer.

4. Customer-Supplied Parts

4.1. HMS offers no warranty or guarantee on any parts or components supplied by the customer.

4.2. Installation or use of customer-supplied parts is done entirely at the customer's own risk.

4.3. HMS accepts no responsibility for performance, compatibility, or safety issues arising from customer-supplied parts.

5. Ownership of Goods

5.1. All parts, materials, and goods supplied by HMS remain the property of HMS until full payment is received.

5.2. In the event of non-payment, HMS reserves the right to remove or reclaim any unpaid goods.

6. After-Hours Call-Outs

6.1. After-hours work (outside standard business hours) will incur premium rates.

6.2. A minimum 4-hour labour charge applies to all after-hours call-outs, regardless of the time spent on-site.

7. Cancellations & Delays

7.1. Appointments cancelled with less than 24 hours’ notice may incur a cancellation or call-out fee.

7.2. Deposits for scheduled work may be non-refundable if parts have been ordered or costs already incurred.

7.3. HMS is not liable for delays caused by supplier shortages, weather, access issues, or unforeseen circumstances.

8. Liability & Workmanship

8.1. HMS takes all reasonable care in providing services, but shall not be liable for any indirect, incidental,

or consequential loss (including loss of business or income).

8.2. Any claim for defective workmanship must be submitted in writing within 7 days of the completion of work.

8.3. Warranty on labour and HMS-supplied parts will be provided as per industry standards unless otherwise stated.

9. Governing Law

9.1. These Terms are governed by the laws of Western Australia.

9.2. Any disputes arising under these Terms will be resolved exclusively in the courts of Western Australia.
